Marc appears before both state and federal courts and the bankruptcy court on a regular basis.
As A Bankruptcy Attorney:
Marc has 20 years of experience practicing before the federal bankruptcy court on behalf of debtors, creditors and bankruptcy trustees. In addition to helping individuals obtain relief from debt, he helps lending institutions and other creditors protect and recover collateral and maximize their recovery during the bankruptcy process. He is regularly retained by bankruptcy trustees to contest fraudulent and preferential transfers and to recover assets for the bankruptcy estate. He also has assisted individuals in completing "workouts" of their financial problems without filing bankruptcy.
As A Trial Attorney:
Marc has conducted several jury and non-jury trials in New Hampshire Superior Courts and the United States District Court for the District of New Hampshire. Marc represents clients in:
- Contract disputes,
- Debtor/creditor litigation,
- Construction claims,
- Employment matters,
- And personal injury cases.
- Whether or not claims such as student loans are dischargeable in bankruptcy;
- The validity and priority of security interests;
- The effect of constructive and resulting trusts on the bankruptcy Trustee's ability to avoid the transfer of property which otherwise would be available to satisfy the claims of creditors.
As A Foreclosure/Creditors' Rights Attorney:
As a foreclosure/creditors' rights attorney, Marc has conducted foreclosure sales for lenders and has obtained injunctions for borrowers to prevent foreclosure sale from going forward.
As An Appellate Attorney:
Marc has briefed or argued over a dozen cases before the New Hampshire Supreme Court in appeals involving various issues, including:
- Insurance issues;
- The liability of parent companies to provide workers' compensation benefits for an employee of a subsidiary;
- The validity of personal guaranties of bank loans;
- The effect of dissolution of a partnership on claims held by creditors of the partnership.
